What Happens if Your Rideshare Driver Gets into an Accident?

When you ride in a Lyft or an Uber, the last thing you’re thinking about is getting into an accident. However, car accidents can and do happen. Sometimes, your driver is at fault. Other times, the other driver has the responsibility.

But what about you as a passenger? What do you do if you’re injured? Who will pay for your medical bills and other issues?

If you are riding in an Uber and there is an accident in which you sustain injuries, Uber has an accident policy. That policy covers the driver for up to $1 million in liability. But there is a caveat: the coverage only happens in if Uber’s driver or the other driver is at fault and has inadequate bodily injury insurance coverage. If the Uber driver has coverage, you will have to deal with his or her insurance company. That is when things get murky.

Uber passengers are not likely to sue the ride-sharing company itself. Drivers are considered independent contractors – not employees. This means Uber can deny liability for crashes. If passengers file a lawsuit, the target would be the at-fault driver. If you are involved in an accident with a rideshare driver that ended up with injuries, have your lawyer send preservation of evidence letter to both Uber and the driver involved.
