Fountain Valley, CA – Boy Killed When Stalled Car Struck by Possible DUI Driver

Fountain Valley, CA (March 31, 2019) – A vehicle accident that involved a car that had stalled in the HOV lane occurred on Saturday night just before 11:00 p.m., ultimately taking the life of a young boy.

A car holding a family of five was located in the HOV lane where it had stalled out on Interstate 405. The vehicle was hit from behind, starting a chain-reaction crash that killed a young boy and injured several people. California Highway Patrol immediately responded to the scene of this fatal accident.

The accident occurred around 10:50 p.m. when the driver of a black Toyota did not see that there was a car stopped in the northbound HOV lane. The Toyota collided into the stopped vehicle from behind and then proceeded to crash into another car.

Emergency responders were called to the scene to render aid the injured drivers. Eight people were taken to local hospitals. Sadly, a boy between that ages of 10 and 12 died at the hospital, succumbing to his injuries.

The Toyota driver had serious, but non-life threatening injuries. He has been placed under arrest on suspicion of DUI.

The cause of the crash is still under investigation.

We would like to offer our sincere condolences to the family and friends of the child who passed away as a result of this fatal accident. Our thoughts are with them at this time. We also send healing wishes to all the injured victims.

Who Is At Fault For A Car Accident with a Stalled Car?

If your car stalls in the middle of the roadway and a separate car hit you from behind, the driver who hit you is almost always at fault. This is because there is an “assured clear distance ahead” rule, which says that you should always keep a safe distance between your automobile and what is in front of you so that you can brake suddenly without causing a crash. You should also always travel at a safe speed where if you need to stop, you can do so safely. The other driver may try to state that they acted reasonably under the circumstances of the accident. If this is what happened to you, get in touch with an injury attorney to discuss your legal options.
