What Happens If My Child is Injured in a School Bus Accident?

Riding a school bus is thought of as one of the safest ways for your child to get to school. School buses are designed to be safer than other vehicles on the road. But, accidents do happen. Between four to six children pass away from school bus-related incidents every year, and many others suffer injuries.

If your child is injured while riding the bus you need to know your options.

Many parties can be liable for injuries received from a bus accident. If these accidents are caused by the bus driver’s carelessness, the driver is liable. The driver’s employer can also be held liable. Many school buses are owned and operated by the school district. As a result, the school district can also be held liable if the bus driver’s negligence causes an accident. Victims have two years from the date of the accident to file a claim against the school district, so it’s vital to file a claim as soon as possible.

Sometimes a bus accident is caused by mechanical failures, such as faulty brakes. In this case, the fault for the accident lies with the manufacturer of the defective part.

A huge amount of school bus accidents involve other cars on the road. When a bus and an automobile run into each other, the fault can lie with the driver of the passenger vehicle. If this is the case, the other driver is negligent and is liable for the victims’ injuries. A personal injury attorney can prove liability using evidence like police reports, witness accounts, and medical records.
