Pedestrian Accidents in California
Studies show that an average of 15 people are struck and killed by vehicles every day in the United States. The leading cause of most pedestrian accidents is driver’s error. When drivers are using their phones, driving above the speed limit, driving under the influence, driving fatigued, or conversing with a passenger, they put themselves and pedestrians at risk of being seriously hurt or killed. To protect pedestrians, California has certain laws for drivers to abide by, such as yielding when a pedestrian is crossing the street, no matter who has the right of way.
The police are examining this accident to determine if the driver will be held fully or partially liable. They’re checking the conditions of the road, the conditions of the pickup truck, and the driver’s state of mind to make sure no drugs or alcohol were involved. Once the police conclude their reports, the deceased man’s family members may be able to file a wrongful death lawsuit.
