Oceanside, CA (December 16, 2018) On the evening of December 15th, a pedestrian suffered from fatal injuries after being struck by a vehicle in the area of Highway 76 and Douglas Drive. According to officials, the accident happened late in the evening just before 10:00 p.m. When emergency crews arrived at the scene, they found the driver responsible waiting with the deceased pedestrian. The police are currently investigating the accident, but they don’t believe drugs or alcohol was a factor in this collision.
We glad to hear this wasn’t another hit-and-run accident and that the driver took responsibility for their actions by remaining at the scene. We send our condolences to the deceased victim’s family members, as we know it’s never easy to lose a loved one in a pedestrian accident.
Pedestrian Accidents in California
It’s unfortunate that thousands of pedestrian accidents occur every year in California despite the fact that California has laws requiring drivers to yield as they approach pedestrians. Even if the driver has the right of way, they are still obligated to stop for the pedestrian’s safety. There are cases where pedestrians are walking in the middle of a dangerous highway or are wearing dark clothing at night while they cross the street, but drivers are still required to yield no matter what.
The police are currently investigating this accident to determine if the driver will be held fully responsible. Depending on what they conclude, the deceased person’s family could pursue a wrongful death lawsuit with the help of a California attorney.
