Bicycle Accidents in California
Recent studies show that an average 2 people per day lose their lives in bicycle accidents in the United States, with the number one causes being negligent driving. Drivers don’t always lookout for bicyclists on the road or respect them. Even though bicycles are not considered vehicles, the same rules of the road apply to them, which means drivers should still treat them as if they are another vehicle as long as they’re abiding by traffic laws.
The police are currently investigating this accident to determine if the driver will be held fully or partially liable. They’re checking to see if the driver was aware of the bicyclist, and if negligence played a role in this accident. They’re also checking road and vehicle conditions to see if any malfunctions helped caused the crash. Once they finalize their reports, Wagner’s family may be able to file a wrongful death report with the help of a California wrongful death attorney.
