Vehicle Accidents in California
Because the leading cause of most vehicle accidents in California is distracted driving, most car accident lawsuits are governed by the law of negligence. When a driver fails to exercise a certain level of care that a reasonably careful person would, they’re committing a civil wrong. Another form of negligence is when a person witnesses a negligent act and does nothing to help improve the circumstances. For injured victims wanting to prove negligence claims, they must prove all four elements, which are duty, breach, causation, and damages.
The police are investigating this accident to determine who will be held liable. Depending on their findings, wrongful death lawsuits will more than likely be filed with the help of a California wrongful death attorney.
