Injury Accidents in California
When someone is injured in a car accident, figuring out which of the drivers was at fault is often the most difficult but also the most important part of the process for investigators. California is what is known as a comparative negligence state when it comes to traffic accidents. It is a legal defense that is used by many states to effectively divide up the blame when it comes to car accidents. The law of comparative negligence reduces the amount you are able to recover for damages by the percentage of the fault that has been attributed to them.
For example, if a driver #1 causes an accident by smashing into vehicle #2 when vehicle #1 was trying to make a lefthand turn across traffic then they either ran a light or did not yield the right of way. Let’s also say that car #2, coming from the opposite direction, did not have his lights on and it was grey and rainy outside. An insurance adjuster may determine that car #1 is 75% at fault for the accident and car #2 is only 25% at fault for the accident. If car #2 then attempted to collect $100,000 in damages from car #1 and won their case, they would only be able to collect $750,000 because the other 25% of the fault was their own. Â
If you have been injured in an accident, regardless of the percentage of fault that has been assigned to you, it is always a smart move to retain legal counsel. The insurance companies are looking to minimize their payouts, not looking out for your best interests.
