California Personal Injury Laws
Here is a summary of California laws that can impact a settlement after a crash.
First of all, is time – The statute of limitations for personal injury cases is two years. There is also a time limit of six months to file an injury claim against any government agency.
In some personal injury cases, the defendant may try to say that you’re partially to blame. If this is the case, it can affect your compensation, reduced by an amount equal to your percentage of fault.
Most uninsured drivers cannot receive damages after a car accident, even if the other driver is totally at fault. One exception: The uninsured driver can recover compensation if he or she is in an accident with a driver who was under the influence of drugs or alcohol.
