Pedestrian Accidents in California
Unfortunately, the number of pedestrian fatalities is continuing to increase every year in California with the main cause being negligent driving. To decrease the number of pedestrian accidents, the state government has a set of laws protecting pedestrians, which includes a law that requires all drivers to yield as they approach pedestrians, even if the pedestrian is illegally in the street. No matter what, the pedestrian always has the right of way since their bodies are highly susceptible to injuries caused by vehicles.
Depending on the cause of the accident, sometimes pedestrians are held partially liable. The police are currently evaluating this accident to determine if Eylicio or the other driver had the right of way. They’re also evaluating all possible factors that could have played a role in this collision. Once they finalize their report, it’s likely that Eylicio’s family will be able to file a wrongful death lawsuit with the help of a California wrongful death attorney.
