What is Considered Negligence?
Negligence means that the responsible party acted in a way that disregarded safety on the road, resulting in injury. Most car accident lawsuits are based on this carelessness, legally proving that the party is at fault.
Four items must be satisfied to prove negligence in a car accident:
- The Duty of Care: Drivers must drive safely and obey traffic laws
- The defendant breached their duty to drive safely
- Causation: The defendant’s breach caused injuries and they are therefore liable
- Damages: The is a calculation of the losses and costs associated with the injury
