California Highway Patrol responded to the scene of this fatal accident.  According to CHP officers, the crash occurred on El Toro Road and Aliso Park

Two vehicles were involved in the crash. A red 2003 Hyundai Elantra was heading southbound on El Toro Road when it collided with a black 1991 Mazda Protégé that was making a left turn from El Toro Road onto Aliso Park Drive.

Emergency responders were called to the scene to render aid. Though at first, it appeared that none of the injuries sustained in the crash were traumatic, a woman later died from her injuries.

Wrongful Death Lawsuits in California

In California, a “wrongful death claim” happens when a person dies as the result of the wrongful act or carelessness of another person. A wrongful death claim is a civil proceeding. It is brought to court by the survivors of the deceased, or by the representative of the deceased’s estate, and the fault is money damages, where the court orders the defendant to pay the deceased person’s survivors.

A wrongful death claim is different from a criminal case, which is brought by the state and where guilt is penalized with jail time, probation, or fines. You may bring a civil wrongful death claim even if a criminal case is already happening.

Only specific people are allowed to file a wrongful death lawsuit. These include the deceased’s:

  • Surviving spouse
  • Domestic partner
  • Surviving children

If your family member has passed away due to a car accident, contact a personal injury attorney to see what your next step should be. The statute of limitations for a wrongful death claim is two years.
