DUI Accident Claims in California
DUI accident claims in California are very common. In fact, the number of accident injuries involving alcohol averages between 10 and 12 percent. Males are also more likely to drive under the influence.
The average BAC of a DUI driver is .15 percent but a BAC as small as .02 percent has been proven to affect motor skills required for driving. Likewise, drugs severely affect the ability to drive by impairing perception-reaction time.
It is unlawful for any person to drive an automobile after abusing any illicit drugs or a measurable amount of alcohol. The BAC limit is .08 and the driver must be 21 or older.
If you are involved in a DUI accident, you can file a civil claim for personal injuries. You can recover money damages for bodily harm and property damage. California Supreme Court has stated that punitive damages are available to be recovered from an intoxicated automobile driver because the person who drinks or does drugs knowing they will then drive an automobile demonstrates a deliberate disregard to the safety of other people.
