Who Can Bring A Wrongful Death Lawsuit After A Car Accident In California?

Heirs and family members of deceased victims may bring a wrongful death lawsuit after a fatal car accident. These are the parties that may have the right to pursue a personal injury claim depending on the circumstances:

  • Spouse
  • Children
  • A representative of the deceased’s estate
  • Stepchildren
  • Parents of the deceased
  • Grandchild
  • Siblings and other relatives
  • Spouse from a dissolved marriage
  • Domestic partner
  • Any minor who depended on the deceased

Only one wrongful death lawsuit can be brought forward from death, but multiple individuals can lay claim in the lawsuit.

What is a survivorship claim? A survivorship claim is separate from wrongful death, but often these two claims are brought together in the same lawsuit. A survivorship claim leads to compensation for expenses that the deceased incurred prior to their death. These are things like medical expenses, ambulance fees, and loss of earnings.

Usually, expenses that are resulting from the death – such as funeral and burial expenses – are included in a wrongful death claim. You should remember that a wrongful death lawsuit is a civil action, not a criminal case.
