San Diego, CA – Motorcycle Accident on 805 Freeway
Motorcyclist Injured in Motorcycle Accident
San Diego, CA (December 4, 2018) A motorcycle and a vehicle collided on the 805 freeway on the afternoon of December 4th. Officials reported that the motorcycle accident happened at around 3:37 p.m. When emergency crews arrived at the scene, they found the motorcyclist sitting against the center divider suffering minor injuries. Tow trucks helped remove both vehicles off the freeway while the police investigated the accident. It’s unclear if the other driver suffered any injuries and if the motorcyclist went to a hospital for evaluation and treatment.
We are glad to hear the motorcyclist only suffered minor injuries as we know thousands of motorcyclists lose their lives every year in motorcycle accidents. We hope the injured victim seeks medical evaluation to make sure no other symptoms develop.
Motorcycle Accidents in California
Motorcycle accidents have increased every year in California for the past decade. Most motorcycle accidents are based on claims of negligence. Therefore, it’s important for injured victims to seek legal representation to help with filing a personal injury lawsuit. When a driver fails to exercise care on the road, they’re committing a civil wrong because they’re putting others at risk.
If the police discover that the other driver is liable for this accident, then it will be easier for the motorcyclist to prove their negligent act claim. The rider must prove that the other driver had a legal duty to look out for him on the road, and that the driver failed to perform that duty. He must also prove that failing to perform that duty caused him to suffer personal injuries and vehicle damage. If the motorcyclist is partially at fault for the crash, then the amount of compensation hey may be entitled to lowers. The motorcyclist should file his personal injury claim as soon as possible because the statutes of limitation only allow a certain amount of time before all claims are barred.
