Hit By A Police Car? Making A Wrongful Death Or Injury Claim In California
Crashes that involve a police car are not always similar to other kinds of car accidents. If a driver or pedestrian is struck by a police car, the police may have some immunity, especially if the patrol car’s lights and sirens were on. However, the police and the city can still be liable to an injured driver, passenger, or pedestrian if they cause injuries with the accident.
Injury victims or their families can file a personal injury claim or wrongful death lawsuit involving a crash with a police car. Liability depends on whether the police officer was responding to an emergency, had lights or sirens on, or if they were simply driving carelessly.
If the police officer is determined to be negligent, then the victim or their families may be able to recover compensation. Depending on the law enforcement agency, the state, county, or city could be held liable.
If you have been struck by a police vehicle and suffered injuries, you should retain the services of a personal injury attorney to help gain recompense.
