Damages and Liability for Road Rage Incidents in California

Over the last few years, incidents of road rage are slowly increasing. Sometimes these cases result in personal injury. When you are a victim of this kind of incident, you may wonder, “Can I sue the other driver?” Assuming that you have the identities of the person who caused the injury, you may be able to sue the driver, in addition to any potential criminal charges.

If you were injured in a road rage incident, obtain your medical bills and reports. These will support your claim for damages. Since assault and battery are obviously intentional acts, in addition to compensatory damages for your medical injuries, you can also seek punitive damages against the other driver. Punitive damages punish the other party for intentional, malicious acts that caused you suffering and injury. A personal injury attorney can assist you in this kind of claim.

In addition to your civil suit and filing an insurance claim, you should contact the police and/or the district attorney’s office to pursue criminal charges against the driver in the road rage incident.
