San Jose, CA – UPDATE: Marianne Natividad Killed in Hit-and-Run Pedestrian Accident on Nieman Blvd
San Jose, CA (April 16, 2019) On the 10th of April, a fatal hit-and-run pedestrian accident occurred on Nieman Boulevard and Laddie Way.
The reports state that a light-colored 2000 Toyota 4Runner struck a 48-year-old woman named Marianne Natividad. She was walking across the street headed east on Nieman Boulevard as the Toyota was traveling north.
The driver responsible for hitting Natividad, 65-year-old Delilah Paray, got out of her vehicle to evaluate the scene, then got back in and fled. Unfortunately, because Paray did not help Natividad, she continued to get run over by other vehicles.
When emergency crews got to the scene, Natividad had suffered fatal injuries in the roadway.
The accident is still under investigation, but the police were able to track down Paray’s Toyota and then arrested her. She has been charged with felony hit-and-run and taken to Santa Clara County Main Jail. The other drivers who ran over Natividad appeared to be unaware that she was lying in the roadway.
We send our sincere condolences to the family of Marianne Natividad at this time. Our thoughts are with them right now.
Hit-and-Run Accidents in California
According to recent statistics, about 60 percent of all hit-and-run accidents in California involve pedestrians. Drivers are either unaware that they struck a pedestrian due to being distracted, under the influence, or fatigued, or they are aware but fear getting caught for their actions. It’s always irresponsible and inconsiderate to strike a pedestrian and leave them on the roadway to suffer. If drivers would have stayed at the scene and called for help, many more pedestrians might still be alive today.
For individuals who have lost loved ones in hit-and-run accidents, it’s highly important to immediately seek help from an experienced California wrongful death attorney and file a wrongful death lawsuit. The more time that passes, the higher the chance of a claim being deemed invalid due to the statute of limitations. At Brady Law Group, we help our clients with every aspect of the legal process until we have done everything possible to help them file and win their case.
