What Happens If My Child Is Injured In A Car Accident in California?
Our children are the most important people in our lives. And if our child is hurt, it can change a parent forever. If your child is hurt in a car accident, questions are probably running through your head, like can you sue for damages if your child is injured?
Children cannot bring their own claim against a third-party. Therefore, if a lawsuit is deserved, a parent or guardian must file it on behalf of the child. If you choose to go this route, there are a few things you need to know:
- Who was responsible for the accident that caused the child’s injury.
- The compensation awarded minors are somewhat limited. Most insurance companies will cover the medical costs of a child but if there’s a dispute regarding these charges medical expenses can be added to damages.
- Other damages include mental injury, anguish and fear, and loss of possible livelihood.
- You have two years to file a claim or accept a settlement in a case that involves a child.
Children mean the world to us, and that’s why you need a personal injury attorney that is genuinely focused on the welfare and rights of your child.
