San Jose, CA – Three-Year-Old Boy Dies After Being Hit By Pickup Truck in Parking Lot On South 24th St. And East Santa Clara St.

San Jose, CA (June 23, 2019) – A pedestrian accident involving a three-year-old boy occurred on June 22 just before 10 a.m., that took the life of the child.

California Highway Patrol responded to the scene of this fatal accident.  According to CHP officers, the incident occurred in a parking lot near a business at the intersection of South 24th Street and East Santa Clara Street on Saturday morning.

The boy and his mother had pulled into a parking lot near a local business. The mother was walking towards the business when her son got out of their car and walked into the lot. The boy was then struck by a 2012 Nissan pickup.

The pickup driver drove the boy and his mother to Regional Medical Center, where they were met by police. He was then later moved to Stanford Medical Center in Palo Alto, where he succumbed to his injuries.

We would like to offer our sincere condolences to the family and friends of the young victim who passed away as a result of this fatal accident.  Our thoughts are with them at this time.

Wrongful Death Of A Child In California

What is the price of human life? This is what is determined by a wrongful death suit and it is not easy. When it comes to the death of a child, how is value assessed?

When someone passes away, their earning potential – the amount they would have made in income had they survived – is calculated. Because of this, a person’s age, education, and career are strongly assessed. Another factor is how much sympathy there is for the deceased person and their family.

You can’t use the standard model to put a value on the wrongful death of a child. So how is it done? When a child dies, the parents’ recovery is limited to their financial loss:

  • Age, sex, life expectancy, work expectancy, state of health, and habits of the deceased child
  • The child’s earning potential
  • The relationship to those claiming a monetary loss
  • The circumstances of the claim

Their recoverable damages are medical, hospital, and medication expenses – such as ambulance rides, emergency surgery, and life support. Parents can also claim loss of consortium which covers non-monetary losses like love and companionship of the child. The actual amount recoverable depends on factors like the child’s age, health, and the situation of the parents.

Parents may also be able to recover for their own grief, mental anguish, or suffering caused by the death of their child. These damages can include expenses like psychological treatment, grief counseling, support for siblings, and psychological medication.

If your child has passed away because of the negligence of another person, contact an experienced wrongful death attorney immediately. No parent should ever have to bury their child, but it happens, and you should get the needed support that you deserve in this terrible time.
