DUI Accident Claims in California
DUI accident claims in California are commonplace. In fact, the CA Department of Alcohol and Drug Programs stated that the number of accident injuries involving alcohol averages between 10 and 12 percent for the past several years. Drivers aged 21 to 24 years comprise about 35% of the persons arrested. Males are also more likely to drive drunk.
Alcohol and drugs like marijuana, heroin or opiates severely impact the capacity to drive by affecting sensory perceptions including the delay in reaction time. The BAC limit is .08.
In addition to criminal charges, a drunk driver can be held liable for recovery of damages to the victim. As well, the California Supreme Court has held that punitive damages are recoverable from an intoxicated driver because the person who drinks or does drugs and then drives demonstrates a willful disregard for the safety of other people.
