Pedestrian Accidents in California
Studies show that one in every five children under the age of 15 suffered fatal injuries after being struck by vehicles in 2015. There are a variety of reasons why pedestrian accidents occur, but the most common cause is negligent driving. There are California laws that require drivers to yield to pedestrians no matter the circumstances. When proving liability, there are some cases where pedestrians are held partially responsible for causing an accident. For example, if a pedestrian walks into the middle of the street wearing dark clothing at night, they’re putting themselves at risk of being hit. The police are currently investigating this accident to discover if the driver will be held fully liable. Depending on what they conclude, the child’s parents could file a personal injury lawsuit on her behalf.
