San Juan Capistrano, CA – Pedestrian Killed on I-5 North Just South of CA-73

San Juan Capistrano, CA (March 24, 2019) – A 21-year-old man was hit and fatally injured by a vehicle when running across the northbound lanes of Interstate 5 on Friday, March 22nd.

California Highway Patrol responded to the scene of this fatal accident. According to CHP officers, the incident occurred south of the 73 Toll Road around 8:45 p.m.

Officers arrived on scene and found the pedestrian, a man from San Juan Capistrano, unresponsive on the left shoulder. He was hit by a 2003 Kia that was traveling northbound as he was standing between the carpool lane and the far left lane of traffic on the freeway.

The driver of the Kia, who was a 25-year-old man from Los Angeles, attempted to avoid the pedestrian but was not able to veer to the right because there was another vehicle in the space. He was uninjured in the crash and remained on-scene to cooperate fully with investigators.

The pedestrian was pronounced dead at the scene. His identity was not released. It is not immediately known if drugs or alcohol were a factor in the incident.

We send our heartfelt condolences to the family and friends of the young man who lost his life in this incident. Our thoughts are with them at this difficult time.

Can the Pedestrian Be at Fault in a Car-Pedestrian Accident?

When you think about accidents between vehicles and pedestrians, the initial assumption is that the driver of the car is to blame. The old adage is “the pedestrian has the right of way.” However, that isn’t always correct legally. Sometimes in a pedestrian-vehicle accident, the pedestrian can actually be at fault, either wholly or partially.

The assignment of fault in a legal claim from a traffic accident is sometimes confusing. Information about the accident helps to determine what actually happened. You need witness accounts, the stories of both the pedestrian and the driver, any applicable laws and the police report.

If the driver is clearly at fault, the pedestrian will be able to recover compensation from the driver. However, if the pedestrian bears all of the blame, the driver may actually be able to sue the pedestrian for compensation for any harm or injuries to the driver.

If you have been involved in a pedestrian accident, you may need legal representation in order to receive the compensation you deserve. Call the Brady Law Group at 866-478-6483 to speak to an accident attorney with a track record of success in California accident cases.
