Proving Medical NegligenceMedical negligence cases are extremely complex and expensive to pursue. A great deal of investigation, research and analysis must be done by qualified medical and legal personnel in the beginning of the case to help establish the facts and the nature of the plaintiff’s injuries. As the case proceeds, testimony from a variety of different experts will be required to prove the various elements of the claim. For example, the plaintiff will need to present expert testimony in order to establish the exact standard of care that should be applied in the case. He or she will also need one or more experts to prove that the defendant breached that standard of care. This process is not only extremely expensive, it is often difficult to find doctors who are willing to testify against their peers. These are significant barriers which prevent many people from bringing legitimate claims. At The Brady Law Group, we eliminate these barriers. We have significant financial resources and a highly experienced team of medical experts who are willing to stand up to other doctors in their field of specialty and help us prove the mistakes that were made. We will evaluate your claim and have your medical records looked at by a professional. If a medical negligence claim is warranted and we accept the case, we will proceed on a contingency fee basis. This means that we will pay all of the expenses required to investigate, prove and present the case in court. If we do not recover, you owe us nothing. If we successfully resolve the case, we will receive a percentage of the recovery and reimbursement of our expenses. It is very important to understand that medical negligence claims are governed by strict statutes of limitation. These laws limit the amount of time you have to file a lawsuit. If the applicable deadline is missed, the claim will be forever barred and the plaintiff will not be able to recover any damages for the harm they suffered. |
