Products Liability Claims in Spinal Cord Injury CasesIf a plaintiff’s injuries were caused by a defectively designed or manufactured product, the plaintiff can file a products liability lawsuit against the sellers of that product. Products liability lawsuits are governed by special rules which sometimes make it easier for the plaintiff to establish liability on the part of the defendants. Generally speaking, there are three types of product defects which may cause injury thus giving rise to liability on the part of the sellers of that product: design defects, manufacturing defects, and marketing defects. The “sellers” of the product include all parties who are in the product’s chain of distribution, such as the product’s designer, manufacturer, wholesaler, or retail supplier. These cases will generally be based on theories of negligence, breach of warranty and / or strict liability. Every spinal cord injury case is different and the unique circumstances surrounding the accident will determine the best products liability theory to pursue and type of evidence that will be required to prove the plaintiff’s case. It is often difficult, if not impossible for the ordinary consumer to determine whether their injuries were caused by a defective product. Investigating such claims can be very difficult and will typically require extensive work on the part of experts from a variety of disciplines. Litigating products liability claims is equally difficult and you should seek the advice of an experienced California products liability attorney as soon as possible after any serious accident. If you or someone you love has been injured in any type of accident, and you suspect that a defectively designed or manufactured consumer product is to blame, contact The Brady Law Group for assistance.
