Damages In Car Accident Cases

As noted above, in order to prevail in a car accident lawsuit the plaintiff must prove that they suffered actual harm to their person or property.  If the plaintiff can prove that this harm was caused by wrongful conduct of the defendant(s), they will be entitled to recover compensation.

The damages that may be recovered in a personal injury lawsuit will vary depending on the facts of each case but can generally include past and future medical expenses, lost wages, property damage and pain and suffering.  In some auto accident cases, punitive damages may also be available.

It is very important to note that all lawsuits related to car accidents will be subject to various “statutes of limitation” which limit the amount of time you have to file a claim.  If the applicable deadline is missed, your right to recovery will be lost forever.  In order to protect your legal rights and the value of your claim, contact The Brady Law Group and speak with one of our experienced California trial attorneys as soon as possible after an accident.
