Car Accident Lawsuits- An Overview

For most working adults, time spent on the road running errands and commuting to and from work makes up a significant portion of their day.  Naturally, more time on the road means greater odds of being involved in a car accident.  According to recent National Highway Traffic Safety Administration (NHTSA) statistics, there were more than 6,000,000 traffic accidents in the United States in 2007.  Many of these accidents only involved property damage and the vehicle occupants are not injured.  Unfortunately, this was not the case for over 2.5 million Americans in 2007.

If a person suffers injuries from a car accident, they can file a personal injury lawsuit against the responsible parties seeking compensation for their injuries.  If a person dies in a car accident, the family members of the deceased can file a wrongful death action against those parties who were responsible for the death.  As we will explain in more detail below, car accident lawsuits will generally involve claims of negligence, products liability, or some combination of the two.  All car accident lawsuits will require the plaintiff to prove causation, liability and damages.  Regardless of the legal theory pursued, a car accident that results in catastrophic personal injuries or a wrongful death will require experienced legal counsel.  Such cases can be very difficult and there is simply too much at stake to choose a lawyer without the proper level of skill and training.
