Spinal Cord Injury Lawsuits - An Overview

Spinal cord injuries can be life-altering events for both the victim and their families.  These injuries are not only physically devastating, they are also emotionally, mentally and financially draining.  The first and most important thing to do if you or a loved one has suffered a spinal cord injury is get proper medical attention immediately.

As soon as the injuries have stabilized, the victim or a family member should contact an experienced California attorney and discuss the facts of the case.  If you wait too long to contact an attorney, you could lose precious evidence or otherwise reduce the value of your claim.  Also, you should never sign any documents after an accident without first consulting an attorney.  If the spinal cord injury was caused by another person’s negligence or defective product, a civil lawsuit can be filed seeking damages from the responsible parties.

Spinal cord injury lawsuits can be extremely complex and they should only be handled by attorneys with experience in similar catastrophic injury cases.  Significant resources must be expended immediately after an accident to make sure the facts of the case are properly investigated and that all available evidence is gathered and protected.  If a mistake is made at this stage of the case it can greatly diminish the value of the claim and the plaintiff’s ability to succeed in any subsequent litigation.

Attorneys, their staffs, and various experts will use the time immediately following an accident to gather physical evidence, obtain official reports from the police or other first responders, interview witnesses, take photographs, and compile information regarding the victim’s physical injuries.  Documents such as medical reports, bills, and employment records will be assembled whenever they become available and used to help establish the plaintiff’s damages.

From the very beginning of the case, the attorney you select will have an enormous impact on the outcome of the litigation.  An experienced lawyer with a strong reputation and a history of large trial verdicts will not only be able to properly investigate and prepare the case, he or she will be able to illicit much higher initial settlement offers from the defendants and their insurance companies.  Conversely, an inexperienced attorney, or one without trial credentials, will be stonewalled by the insurance companies and could easily make costly mistakes in the investigation stage of the case.
