Rollovers
Vehicle rollover accidents are a common occurrence on highways and roads throughout California and the United States. Every year, thousands of people suffer catastrophic personal injuries and lose their lives in these horrific accidents. According to the National Highway Traffic Safety Administration (NHTSA), approximately 28,933 vehicle occupants were killed in traffic accidents in the year 2007 alone. More than 35 percent of those fatalities occurred in rollover accidents. Out of the 10,194 people who lost their lives in rollover accidents in 2007, approximately 54 percent of them were occupants in Sport Utility Vehicles (SUV’s) and pickup trucks. NHTSA statistics regarding personal injuries from vehicle accidents in 2007 closely correlate to the fatality data noted above. According to recently released NHTSA data, approximately 224,000 people were injured in rollover accidents in the United States during 2007. Injuries from rollover accidents thus accounted for roughly 10 percent of all vehicle occupant injuries in 2007. This figure represents an increase of more than 8 percent over the 2006 injury total. As with the fatality statistics, the 2007 NHTSA data shows that approximately 54 percent of the vehicle occupants injured in rollover accidents were riding in SUV’s and pickup trucks. As we will discuss in more detail below, several different vehicle design and manufacturing defects can cause or contribute to rollover accidents. Chief among these causes are stability-related defects and tire defects. The severity of the personal injuries and the likelihood of death in a rollover accident are also both increased when the vehicle or its key safety features suffer from design or manufacturing defects. For example, a defectively designed or manufactured vehicle roof can easily be crushed in a rollover accident, a scenario known as “roof crush.” Roof crushes compound the severity of a rollover accident and the injuries suffered by the occupants. Similarly, defective seat belts or airbags will exponentially increase the odds of catastrophic personal injuries and death in the event of a rollover accident. Lawsuits related to vehicle rollover and roof crush accidents are very complex and expensive to pursue.
