Common Seat Belt Defects

There are a variety of different manufacturing and design defects which may affect the proper functioning of a seat belt.  Design defects relate to the pre-construction, intentional design of the seat belt or system.  One example of a seat belt design defect is the lap-only configuration which is now widely understood to be inherently unsafe.  Manufacturing defects are related to the manner in which the seat belt is actually built and installed.  Some manufacturing defects can be proved by demonstrating that the seat belt does not conform to the specifications of the designer or manufacturer, for example when a bolt is missing. 

The most common seat belt defects relate to latch malfunctions, lap-only belts, shoulder belts, retractor failures, vehicle system failures, child seat belts and booster seats.  Other defects frequently seen in seat belt lawsuits and product recalls include ineffective tension sensors, missing parts, warning light failures, faulty anchorage or anchor plates, release buttons that do not sit flush with the top of the buckle, insufficient webbing material strength or sewing problems, and many others.  A review of NHTSA safety belt recall list reveals a staggering number of different defects associated with these key safety devices.     

Some seat belt defects will result in the passenger not being properly restrained in the event of a collision.  Other defects may directly cause injuries to the vehicle occupant.
